Denver Chapter's Double Session Spring Symposium, April 14, 2009 NCMA Denver
Chapter is pleased to present a double session spring symposium this year on
April 14, 2009, at the Franciscan Event Center, featuring Thomas G. Reid, CPCM,
JD, author, speaker, government attorney and business executive with nearly 30

The morning session (8:00 a.m. to noon) is focused on Contract Terminations. Did you know that the government can walk away from a contract if doing so is deemed to be in the public interest? This class will show you how to be prepared for a termination action from both the government and the contractor perspectives. You'll learn the legal basis for termination actions, steps that must be taken to resolve terminations, and how to prevent a termination. While no one likes a termination (it is considered an extraordinary contractual action) it is sometimes necessary. Whether for convenience or default, the FAR prescribes a variety of options and steps that must be taken for a termination to be valid. A default termination also gives the contractor certain rights to appeal, with a defined process for doing so. Everyone will encounter a termination at some point in their career. Some contracting professionals spend their entire career solely on terminations (such as a government TCO) and your understanding of government contracting is simply incomplete unless you understand the extensive coverage of the subject from the FAR. Attend this four hour class and understand the role of the contracting officer, the actions required to be taken by the contractor, and the extraordinary actions both parties must take to resolve the many lingering contract actions. Every attendee will receive a copy of Contract Terminations published by Management Concepts and a workbook containing all of the presentation charts.
The afternoon session (1:00 - 5:00 p.m.) is focused on Government Contract Law Basics: What are the legal underpinnings for the government procurement process? What statutes govern the development of regulations and the overall procurement process? What legal theories affect the process and does it matter what legal theories the government appeals to in drafting the regulations? Get an overview of the legal underpinnings of the contracting process. Learn why things are done in certain ways, and become familiar with the constitutional, statutory, and regulatory laws behind the rule or practice. This class will equip you with a deeper understanding of government contracting practices to help you understand all your contracting activities and the reasons behind them. Whether you are a certified professional, novice or senior manager you will learn a great deal about the contracting process and the legal theories behind the rules. Every attendee will receive a copy of Government Contract Law Basics published by Management Concepts and a workbook containing all of the presentation charts.

April 30th Cost and Pricing Training
Join NCMA Denver Chapter for our first evening training on Thursday, April 30, 2009, featuring Tom Lemmer, McKenna Long & Aldridge LLP, who is nationally known for his cost and pricing experience. This cost and pricing training session will include key fundamentals and current hot topics regarding how to price contracts, accounting for costs and audit issues. May 12th Breakfast Meeting
Our May 12th NCMA breakfast meeting is a follow up to the hugely successful January meeting regarding energy contracts. We are excited to present Julia Trautman and Greg Moore, two wonderful speakers representing the Department of Energy (DOE). Julia and Greg will be
speaking about a hot topic right now, Energy Savings Performance Contracts (ESPCs). DOE has awarded 16 new ESPCs since December 17, 2008. ESPCs allow federal agencies to accomplish energy savings projects without up-front capital costs and without special Congressional appropriations.
Topics of discussion will include: (1) what are ESPCs; (2) how do ESPCs meet the energy mandates set forth by Congress; (3) what are the benefits of ESPCs; and (4) how can your agency take advantage of ESPCs.
There has never been a more challenging time for the energy industry than now. In an age of growing concern on the environmental front, this event is sure to provide best practices and solutions necessary for establishing effective and successful contracts. and Study Groups
If there is any interest in
participating in a certification study group, please forward your interest to dcouture@ball.com. List what module you are studying for, what
is a good time for you to meet with others, your general location, do you have
the study materials, etc.
For your convenience – the
Denver Chapter has purchased all of the necessary study materials for all of
the relevant exams, which should greatly reduce your cost investment in
preparing for the exams.
The Chapter will reimburse
each member, up to a lifetime total of $500 for the cost towards study
materials and exam fees, upon successful completion of a certification.

Top Ten Most Negotiated Terms
The International Association for Contract and Commercial Management (IACCM) has issued its annual list of the most frequently negotiated terms. The results raise serious questions about the efficiency and effectiveness of most contract management operations.
Based on a survey of more than 500 international companies, the IACCM study revealed that supply and contract managers (spurred by their legal departments) continue to spend the bulk of their time rehashing and renegotiating the most commonly used terms that appear in every company’s so-called “standard” T’s & C’s.

Congratulations to Matt Gomer for being the Denver
Chapter nominee for
NCMA’s Contract Management Leadership Development
Program (CMLDP).
National has received117 applications from the
Chapters—an all-time high for this program—and the selection committee will
finalize its list very soon. However,
there is some internal discussion on the class size, and this issue will not be
resolved until the Board of Directors meeting at our World Congress on April 4,
2009. Once this is resolved we can then
proceed to confirm each candidate’s availability. Depending on the final class size, it could
be the end of April before the new class is announced.
